Article 1 Definitions
In these general terms and conditions the following terms have the following meanings:
a. Webrasa.com: the user of these general terms and conditions.
b. Consumer: other party of webrasa.com who is a natural person and does not act in the exercise of a business or profession.
c. Customer: other party of webrasa.com acting in the exercise of a profession or business.
d. Agreement: the agreement between webrasa.com and consumer / customer.
Article 2 Applicability
These general terms and conditions apply to all offers from www.webrasa.com (hereinafter referred to as webrasa.com).
Article 3 Establishment of the agreement
3.1 The agreement is concluded by acceptance of the offer by the consumer / customer and compliance with the corresponding conditions. Acceptance takes place by receipt of the order via the webrasa.com website. The agreement is concluded when webrasa.com has processed the order.
3.2 There is no minimum order amount for consumer / purchaser.
3.3 After the order placed has been processed, a confirmation will follow by e-mail.
3.4 Once payment has been received and the shipment is offered to the carrier, another confirmation will follow by e-mail.
Article 4 prices
4.1 All prices are inclusive of Dutch VAT, exclusive of packaging, transport, shipping and insurance costs.
4.2 The prices are in Euro, including Dutch sales tax and excluding other government levies, unless expressly agreed otherwise. If the customer is not in the country of the shipment, the customer is liable for any other costs or charges due such as sales tax, customs charges, import duties and clearance and handling charges.
4.3 The prices shown on the website are subject to change.
4.4 As long as the agreement has not been concluded, webrasa.com is authorized to change the prices and other conditions stated on the website.
Article 5 Payment and collection
5.1 With an order you must always pay in advance by means of the payment options indicated on the payment page. The order will only be shipped after payment has been made. The order must be paid within 8 days. If the order is not paid within 8 days, it will be canceled. This term can be extended in consultation.
5.2 Payment can be made in the following ways:
a. Prepayment: consumer / customer can transfer the total amount to NL56 KNAB 0257 2275 71 in the name of Webrasa in Tilburg, stating the invoice number / order number.
b. Cash: The consumer / customer can pay the amount due in cash when collecting the products.
c. The consumer / customer can pay the amount due by internet banking in one of the ways offered at the checkout.
5.3 In the event of non-payment of the consumer / customer, webrasa.com will transfer its claim to its collection agency after a reasonable period has elapsed, and thus has the right to increase the collection costs reasonably incurred by the statutory interest.
5.4 If the consumer / buyer fails to pay within the period of 14 days, it is legally in default. The consumer / customer then owes an interest of 1% per month, unless the legal interest is higher, in which case the legal interest applies. The interest on the due amount will be calculated from the moment that the consumer / customer is in default until the moment of payment of the full amount.
5.5 All reasonable costs incurred in obtaining payment out of court are for the account of the consumer / customer.
5.6 Any reasonable judicial and execution costs incurred will also be for the account of the consumer / customer.
Article 6 Delivery
6.1 Delivery by webrasa.com takes place by delivery to the carrier or upon collection by consumer / customer.
6.2 Shipments are made at the expense and risk of the consumer / purchaser. Webrasa.com arranges the shipping method.
6.4 Shipping usually takes place within 3 working days after receipt of payment.
6.6 The maximum delivery time is 30 days unless otherwise agreed and after a delivery time of 10 days or more, the consumer / buyer will be contacted. If the delivery time of 30 days cannot be used due to any circumstances whatsoever, webrasa.com will inform the consumer / customer of this. The part of the order that cannot be delivered on time will then be sent or canceled free of charge in consultation.
6.7 If a problem is found upon receipt of the delivery, such as damage to the package, this must be made known by placing a reservation on the delivery note, keeping goods and packaging as they are, taking as many photos as possible of the packaging and contents and reporting this within 24 hours via info@webrasa.com.
6.8 If delivery of an article turns out to be impossible for whatever reason, webrasa.com can terminate the agreement. The consumer / customer will be informed of this by e-mail.
6.9 The consumer / customer is responsible for the correct delivery of address details as well as for passing on address changes when moving. Webrasa.com is in no way liable for incorrect deliveries resulting from the incorrect provision of this information.
Article 7 disputes
7.1 These general terms and conditions are governed by Dutch law.
7.2 Disputes are resolved by mutual agreement as much as possible.
7.3 All disputes that may arise as a result of this agreement or agreements between the parties arising from it will be settled by a Dutch court.
Article 8 copyright
It is prohibited to copy, publish, reproduce or otherwise use text and / or images without written permission. We will take legal action in the event of a violation. All rights are reserved by webrasa.com
Article 9 delivery abroad
Webrasa.com is not responsible for deliveries that go wrong due to foreign legislation. You accept the responsibility to familiarize yourself with the laws, import regulations and customs regulations in force in your country before ordering and you declare that the import of the ordered products is legal in your country and that you are aware of obligations regarding documentation that must be present.
